Beta and Experimental Features Terms

Cloud Posse frequently develops and releases new features as beta, experimental, preview, or alpha (collectively, "Beta Features"). This page sets out the terms that apply to your use of any Beta Feature in Atmos Pro. Where a Beta Feature is labeled as such in the Service or in our documentation, these terms apply in addition to — and, where they conflict, take precedence over — the SaaS Agreement and Terms of Use with respect to that feature.

1. Identification

Beta Features are identified in the Service or Documentation with labels such as "Beta," "Experimental," "Preview," "Alpha," or similar. If a feature is not so labeled, it is part of the generally available Service and is not subject to these terms.

2. No Warranty

Beta Features are provided "as is" and "as available" without warranty of any kind. The warranties in Section 8.1 of the SaaS Agreement do not apply to Beta Features.

3. No SLA Coverage

Beta Features are excluded from the uptime commitment and service credit provisions of the Service Level Agreement. Downtime or errors in a Beta Feature are not counted toward SLA calculations.

4. Not for Production

Beta Features may contain bugs, errors, and incomplete functionality, and may be changed or removed at any time without notice. You should not rely on Beta Features for production workloads or other mission-critical use cases.

5. Changes and Discontinuation

Cloud Posse may modify, suspend, or discontinue any Beta Feature at any time, with or without notice, and without liability to you or any third party. A Beta Feature may be promoted to generally available status, remain in beta indefinitely, or be removed entirely.

6. Feedback

If you provide feedback, suggestions, or other input regarding a Beta Feature, you grant Cloud Posse a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, distribute, and otherwise exploit such feedback for any purpose, including incorporating it into the Service, without obligation or attribution.

7. Confidentiality

Information about Beta Features (including their existence, functionality, and performance) may be designated as confidential. Where so designated, such information is subject to the confidentiality provisions of Section 13 of the SaaS Agreement.

8. Limitation of Liability

Cloud Posse's liability for claims arising out of or related to Beta Features is subject to the limitations set forth in Section 9 of the SaaS Agreement. Without limiting the foregoing, Cloud Posse will not be liable for any lost data, lost profits, or other consequential damages arising from use of Beta Features.

9. Changes to These Terms

Cloud Posse may update these Beta Terms from time to time. Material changes will be communicated through the Service or via email at least thirty (30) days before they take effect, consistent with the notice requirements of the SaaS Agreement.
