Terms of Use

These Terms of Use ("Terms") govern your use of Atmos Pro, a commercial offering from Cloud Posse. By accessing or using Atmos Pro, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Atmos Pro, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use Atmos Pro.

2. Description of Service

Atmos Pro is a GitHub App that simplifies infrastructure deployment by using tools you already use like Atmos, Terraform/OpenTofu, and GitHub Actions. It provides features such as:

  • Ordered Deployments with GitHub Actions
  • Stack Locking
  • Status Reporting
  • Workflow Dispatch Management

From time to time, Cloud Posse may make features available on a beta, experimental, preview, or alpha basis. Use of such features is governed by our Beta and Experimental Features Terms.

3. User Accounts

3.1 Account Creation

To use Atmos Pro, you must create an account using GitHub OAuth authentication. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 13 years of age to create an account. If you are creating an account on behalf of an organization, you represent that you have authority to bind that organization.

3.2 Account Responsibilities

You are responsible for:

  • All activities that occur under your account
  • Maintaining the security of your account
  • Notifying Cloud Posse immediately of any unauthorized use

4. Acceptable Use

4.1 Permitted Use

You may use Atmos Pro for lawful purposes only and in accordance with these Terms.

4.2 Prohibited Use

You may not:

  • Use Atmos Pro for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to Atmos Pro or its systems
  • Interfere with or disrupt the service
  • Use Atmos Pro to harm others or their property

4.3 International Users

Atmos Pro is operated from and hosted in the United States. If you access Atmos Pro from outside the United States, you do so on your own initiative and are responsible for compliance with applicable local laws.

4.4 Acceptable Use Policy

Your use of Atmos Pro is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference.

5. Intellectual Property

5.1 Cloud Posse's Rights

Atmos Pro and its content, features, and functionality are owned by Cloud Posse and are protected by copyright, trademark, and other intellectual property laws.

5.2 Your Rights

You retain ownership of any content you submit to Atmos Pro, but you grant Cloud Posse a license to use, modify, and display such content as necessary to provide the service.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Limitation of Liability

To the maximum extent permitted by law, Cloud Posse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of Atmos Pro. For paid customers, the aggregate liability cap set forth in Section 9 of the SaaS Agreement controls.

8. Termination

8.1 Termination by You

You may terminate your account at any time by contacting Cloud Posse.

8.2 Suspension

Cloud Posse may suspend your access to Atmos Pro immediately, without prior notice, to protect the security of the service, other users, or third parties, or to investigate suspected violations of these Terms or the Acceptable Use Policy.

8.3 Termination

For paid customers, termination for material breach is governed by Section 11.2 of the SaaS Agreement (30-day cure period). For Free-tier and unpaid users, Cloud Posse may terminate your account upon reasonable notice, except where immediate termination is necessary to prevent harm to the service, other users, or third parties.

9. Changes to Terms

Cloud Posse reserves the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
